11. TERMINATION OR RESTRICTION OF ACCESS

12. INDEMNITY

You will indemnify and hold BusinessNetworks.in, its subsidiaries, affiliates, licensors, content providers, service providers, employees, agents, officers, directors, and contractors (the “Indemnified Parties”) harmless from any breach of these Terms of Use by you, including any use of Content other than as expressly authorized in these Terms of Use. Further, nothing in this Agreement shall be construed as granting, by implication, estoppels or otherwise, any license or right to use any Trademark or Copyright without the express written permission of BusinessNetworks.in. The misuse of the Trademark or Copyrighted works displayed in this site, or any other content on the site, is strictly prohibited and may expose you to liability.

14. COPYRIGHT INFRINGEMENT

Notice and Takedown Procedure

BusinessNetworks.in expeditiously responds to valid notices of copyright infringement that adhere to the requirements set forth in the. If you believe that your work has been copied in a way that constitutes copyright infringement, you may provide BusinessNetworks.in’s Designated Agent with a notice that contains all six points enumerated below (preferably via email).

Upon receipt of a valid notice, BusinessNetworks.in will remove or disable access to the allegedly infringing content as well as make a good-faith attempt to contact the owner or administrator of the affected content so they may counter-notice pursuant to The Copyright Act of India, 1957 & Copyright Rules 2013.

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
A description of the copyrighted work that you claim has been infringed upon;
A description of where the material that you claim is infringing is located on the site, including the URL, if applicable;
Your address, telephone number, and e-mail address;
A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and,
A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Be aware that a notice must contain all six points for BusinessNetworks.in to take action. All other notices will be ignored.

Counter-Notification Procedure

The provider of the allegedly infringing content may make a counter-notification pursuant to us. To file a counter-notification with BusinessNetworks.in please provide BusinessNetworks.in’s Designated Agent (listed above) with the following information (preferably via email):

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
Your name, address, and telephone number;
The following statement: “I consent to the jurisdiction of Local District Court for the [insert the local judicial district in which your address is located]”;
The following statement: “I will accept service of process from [insert the name of the person who submitted the infringement notification] or his/her agent”;
The following statement: “I swear, under penalty of perjury, that I have a good faith belief that the affected material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled”; and
Your signature, in physical or electronic form.

Upon receipt of a counter-notification containing all six points, BusinessNetworks.in will promptly provide the person who provided the original takedown notification with a copy of the counter-notification, and inform that person that BusinessNetworks.in will replace the removed material or cease disabling access to it in 10 business days.

Finally, if BusinessNetworks.in’s Designated Agent receives notification from the person who submitted the original takedown notification within 14 days of receipt of the counter-notification that an action has been filed seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on its system, then BusinessNetworks.in will once again remove the file from its system.

Repeat Infringers

In accordance with The Copyright Act 1957 & Copyright Rules 2013, BusinessNetworks.in will, in appropriate circumstances, disable and/or terminate the accounts of users who are repeat infringers.

Accommodation of Standard Technical Measures.

It is BusinessNetworks.in’s policy to accommodate and not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that BusinessNetworks.in determines are reasonable under the circumstances.

15. SECURITY

Any passwords used for this site are for individual use only. You will be responsible for the security of your password (if any). BusinessNetworks.in will be entitled to monitor your password and, at its discretion, require you to change it. If you use a password that BusinessNetworks.in considers insecure, BusinessNetworks.in will be entitled to require the password to be changed and/or terminate your account.

You are prohibited from using any services or facilities provided in connection with this site to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g., password guessing programs, cracking tools or network probing tools) is strictly prohibited. If you become involved in any violation of system security, BusinessNetworks.in reserves the right to release your details to system administrators at other sites in order to assist them in resolving security incidents. BusinessNetworks.in reserves the right to investigate suspected violations of these Terms of Use.

BusinessNetworks.in reserves the right to fully cooperate with any law enforcement authorities or court order requesting or direction BusinessNetworks.in to disclose the identity of anyone posting any e-mail messages, or publishing or otherwise making available any materials that are believed to violate these Terms of Use. BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS BusinessNetworks.in FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY BusinessNetworks.in DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER BusinessNetworks.in OR LAW ENFORCEMENT AUTHORITIES.

16. MISCELLANEOUS

These Terms of Use will be governed and interpreted pursuant to the laws of Maharashtra and Government of India, notwithstanding any principles of conflicts of law. You specifically consent to personal jurisdiction in Maharashtra in connection with any dispute between you and BusinessNetworks.in arising out of these Terms of Use or pertaining to the subject matter hereof. The parties to these Terms of Use each agree that the exclusive venue for any dispute between the parties arising out of these Terms of Use will be in the state and Bombay High Court – Nagpur Bench, Maharahstra, India.

If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and BusinessNetworks.in as a result of this agreement or use of BusinessNetworks.in’s websites.

These Terms of Use constitute the entire agreement among the parties relating to this subject matter and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written between the user and BusinessNetworks.in with respect to BusinessNetworks.in’s websites.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

The Terms of Use may not be assigned by you without our prior written consent, however, the Terms of Use may be assigned by us in our sole discretion.

Notwithstanding the foregoing, any additional terms and conditions on this site will govern the items to which they pertain.

BusinessNetworks.in may revise these Terms of Use at any time by updating this posting.

17. Payments & Refunds

BusinessNetworks.in is a paid business networking platform.
BusinessNetworks.in have all the rights to change, manipulate, cancel or renew membership of any registered user, without any prior notice or intimation.
BusinessNetworks.in Membership fees may change time to time without any prior notice to register users.
No explanation would be provided for the raise/decrease in membership fees or any other fees breakups.

BusinessNetworks.in Membership Refund/Cancellation Policy

Admin of BusinessNetworks.in (BN) reserves all the rights to refuse/cancel/refund a membership in the BusinessNetworks.in.
If Admin refuses a new or renewing membership, registrants will be offered a refund.

Membership Cancellation by Participant

Each payment for membership contains a non-refundable Rs.150 administration fee.
New Membership cancellations (Initial memberships) received within 3 business days of registration are eligible to receive a full refund less the Rs.150 administration fee.
Membership renewals do not qualify for refund, Rs.0.
Cancellations received after the stated deadline will not be eligible for a refund.
Cancellations will be accepted via phone, postal or e-mail.
All benefits and incentives received by participant must be cancelled/returned to the BusinessNetworks.in.
All refund requests must be made by the attendee or credit card holder.
Refund requests must include the name of the attendee and/or transaction number.
Refunds will be credited back to the original credit card used/Acc No. or UPI ID for payment.
In case if the profile creation and all the promotional activity for a new registered member is started after 3 business days then no refunds will be made.

These above policies apply to all BusinessNetworks.in memberships unless otherwise noted in the corresponding program materials. Please read all individual program information thoroughly.

BusinessNetworks.in Event/Webinar/Seminar Refund/Cancellation Policy

Event Cancellation by Sponsor

The BusinessNetworks.in admin (BN) reserves the right to cancel an event due to low enrollment or other circumstances which would make the event non-viable.
If BusinessNetworks.in cancels an event, No refunds will be initiated to any participants .
Should circumstances arise that result in the postponement of an event, registrants will not do full refund but He/She may transfer registration to the same event at the new, future date at no guarantee.

Registration Cancellation by Participant

Unless specifically stated on registration materials, the deadline to receive a refund for your registration is 5 business days before the event.
Event Registration cancellations received prior to the deadline may be eligible to receive a refund less a Rs. 150 service fee.
Cancellations received after the stated deadline will not be eligible for a refund.
Refunds will not be available for registrants who choose not to attend an event.
Cancellations will be accepted via phone, fax or e-mail, and must be received by the stated cancellation deadline.
All refund requests must be made by the attendee or credit card holder/UPI/Acc NO..
Refund requests must include the name of the attendee and/or transaction number and ID Proff.
Refunds will be credited back to the original credit card used/UPI/Acc No for payment.

These above policies apply to all BusinessNetworks.in Events unless otherwise noted in the corresponding event materials. Please read all individual event information thoroughly.

BusinessNetworks.in Goods Refund/Return Policy

All returns of goods and materials purchased directly from the BusinessNetworks.in require prior authorization. Shipping and handling charges are non-refundable, Returns must be authorized by the BusinessNetworksin within 3 days of the invoice date. Within thirty (5) days of purchase, we will replace, substitute or repair, at our sole discretion, any BusinessNetworks.in product that is deemed defective.

Products provided/sold by BusinessNetworks.in partners and affinity programs are subject to the return policy of the partner.
